Chacha Tours Africa Terms and Conditions
The below booking conditions form part of the contract between the safari participants or safari sponsor accepting on behalf of all travelers referred to as “Traveler,” and Chacha Tours Africa, a Tanzanian limited liability corporation, a registered seller of safaris in The United Republic of Tanzania (“Chacha Tours Africa”) for all quotations received or safari arrangements reserved for Tanzania or East Africa in general.
Prices are subject to change without notice due to increases in airfares, transportation charges, hotel rates, exchange rates, government tax, etc. Chacha Tours Africa shall have the option to collect as additional charge such increased costs, tariffs and taxes and to reflect fluctuations in foreign exchange rates. For all reservations made prior to departure, a deposit of 30% of the total per person trip cost, as outlined in your itinerary, is required at the time of making the reservation. Full payment is required at least one day before your safari. Chacha Tours Africa reserves the right to cancel bookings if full payment has not been received at least one day prior to departure of your trip. Airlines and hotels may require payment of a deposit for reservations.
Cancellations received prior to departure may be subject to a cancellation charge. Cancellations received less than 60 days prior to departure will be subject to the following cancellation charge:
- at least 60 days advanced written notice – USD $150.00 cancellation charge
- 25 to 59 days advanced written notice – 25% of the total cost of the trip
- 8 to 24 days advanced written notice – 60% of the total cost of the trip
- 0 to 7 days advanced written notice – 100% of the total cost of the trip
It is unfortunate if you have to cancel a trip, especially if it is last minute. Refunds are very difficult because many of the lodges and permits must be purchased months in advance. To prevent losing your deposit and money due to unforeseen circumstances we strongly recommend purchasing travel insurance immediately after booking your safari or Kilimanjaro climb. .
NO REFUND FOR UNUSED SERVICES
No refund or exchange can be made in respect to accommodations, meals, sightseeing tours, transport or other services which are included in the safari package rate but not utilized by the Traveler.
LIMITATION OF LIABILITY
Traveler understands that Chacha Tours Africa is only an agent for the scheduling of safari services. Traveler is advised that the suppliers appearing in the itinerary information (such as hotels, airlines, and tours) are the parties responsible for providing the safari services purchased. Traveler agrees that Chacha Tours Africa is not liable if a supplier fails to provide the services purchased; fails to comply with any applicable law; or engages in any negligent act or omission that causes injury, damage, delay or inconvenience.
Traveler agrees that Chacha Tours Africa is not responsible for, nor will Traveler attempt to hold Chacha Tours Africa liable for, any injury, damage or loss suffered by Traveler on account of any conditions, actions or omissions that are beyond Chacha Tours Africa’s reasonable control. Traveler will review safari documents for accuracy upon receipt and agrees to contact Chacha Tours Africa if any correction or questions.

Chacha Tours Africa is not liable for any circumstances beyond the reasonable control of Chacha Tours Africa, including without limitation, acts of nature, explosion, flood, tempest, fire, accident, war or threat of war, sabotage, terrorism, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions or other occurrences.
Although unlikely, we may occasionally have to change or cancel your safari arrangements and we reserve the right to do so. This could be due to prevailing conditions or unforeseen circumstances. Chacha Tours Africa is not liable for delays prior to departure or during the course of any safari, whether brought about by unforeseen circumstances or other causes beyond our control.
Itineraries and hotel accommodations may be revised by Chacha Africa Tours as necessary. When possible, Chacha Africa Tours will advise you of any change. Chacha Tours Africa acts only as a booking agent for various hotels and other safari related companies, and has no liability for any aspect of the arrangements and, in any particular source, has no responsibility for any death, personal injury, delay, damage, accident or loss of whatever nature you may suffer. There will be no charge for changes or cancellation if due to natural disasters, civil disturbances, quarantine, etc. Chacha Tours Africa is not liable for any act of omission, default or defect of its owners, managers, employees and agents.
To ensure an efficient resolution of disputes that may arise in connection with your agreement with Chacha Tours Africa, it is agreed by Traveler and Chacha Tours Africa that any disputes, claims, or causes of action with Chacha Tours Africa will be resolved by arbitration conducted in Arusha, Tanzania. By agreeing to this arbitration the right to resolve any dispute through a trial by jury or judge is waived.
Traveler understands that discounted fares typically involve restrictions and that changing any aspect of your safari arrangements may result in additional charges. Traveler understands that if traveling internationally, all travelers must have a valid passport and depending upon their destination and nationality may need to obtain one or more visas. Passport and visa information may be obtained by contacting your country’s website. Passport holders should be sure to obtain entrance requirements.
TANZANIA TOURIST BOARD
This transaction is covered by the Tanzania Tourist Board for consumer restitution fund (TTB) if the seller of safari was registered and participating in the TTB at the time of sale and the Traveler is located in Tanzania at the time of payment. Eligible Travelers may file a claim with Chacha Tours Africa or TTB if the Traveler is owed a refund of more than $50 for transportation or safari services which the seller of safari failed to forward to a proper provider or such money was not refunded to you when required. The maximum amount which may be paid by the TTB to any one Traveler is the total amount paid on behalf of the Traveler to the seller of safari, not to exceed $15,000.
A claim must be submitted to the Chacha Tours Africa and a copy to Tanzania Tourist Board within six months after the scheduled completion date of safari. A claim must include sufficient documentation to prove your claim and a $30 processing fee. Claimants must agree to waive their right to other civil remedies against a registered participating seller of safari for matters arising out of sale for which you file a claim.
Tanzania law requires sellers of safaris to have a trust account or bond. Chacha Tours Africa maintains a trust account. Upon cancellation of the transportation, or safari services, where the Traveler is not at fault and has not canceled in violation of any terms and conditions previously clearly and conspicuously disclosed and agreed to by the Traveler, all sums paid to the seller of safari services not provided will be promptly paid to the Traveler, unless the Traveler advises the seller of safari in writing, after cancellation. This provision does not apply where the seller of safari has remitted the payment to another registered wholesale seller of safari or a carrier, without obtaining a refund, and where the provider defaults in providing the agreed-upon transportation or service. In this situation, the seller of safari must provide the Traveler with a written statement accompanied by bank records establishing the disbursement of the payment, and if disbursed to a wholesale seller of holiday packages, proof of current registration of that wholesaler.
For Travelers purchasing from outside of Tanzania this transaction is not covered by the Tanzania Tourist Board Safari consumer restitution fund.
The airlines and other carriers schedule flights and time of arrival that are subject to change. Chacha Tours Africa is not responsible for any change to a departure or arrival time. Similarly, Chacha Tours Africa may not be able to make any special arrangements if you are delayed.
Please re-confirm your onward flights with the outgoing carrier at least 72 hours prior to departure.
We recommend that you purchase travel insurance prior to your departure to cover the following:
- Trip cancellation and interruption
- Baggage delay, loss and pilferage
- Medical and emergency evacuation
- Accidental death and injury
PARTICIPATION RISKS AND INDEMNITY
Be sure to obtain medical advice and recommended shots prior to your departure. Persons not fit for long trips due to age, disease, chronic illness, physical handicap, advanced pregnancy or mental illness should not participate in rigorous safari programs. Consult your physician for advice on the appropriate malaria prophylactics. Chacha Tours Africa is unable to provide advice or suggestions on malaria prophylactics and whether or not they would be advisable based on your medical history. To obtain medical information, you may contact the center for disease control in your country.
There are certain inherent risks involved in participating in the type of trips offered by Chacha Tours Africa. Participation is at your risk. Safaris involve close encounters with wild animals during game activities as well during stays at camps/lodges. All properties are not fenced so as not to disrupt animal migratory patterns. Travelers are advised to follow the advice and guidance of the camp managers and game rangers while on safari and practice all safety procedures. All travelers acknowledge that they are fully aware of and appreciate the dangers and risks that are associated with game reserves and game lodges particularly from the presence of wild and dangerous animals, reptiles, birds and insects, and the risk of suffering bodily harm, injury, and death which may arise as a result of an encounter with wild animals, reptiles, and birds.
Please advise us of any special requests, e.g. diet, particular room, seating, etc. We can advise our suppliers; however, special requests cannot be guaranteed.
It is the sole responsibility of the Traveler to ensure that his or her safari documents, visa, inoculations, etc. are in order prior to departure. Chacha Tours Africa is not liable if you fail to have the required documents.
LUGGAGE ON KILIMANJARO
Luggage is restricted to 20 kg (44 pounds) maximum per person. Only soft duffel bags will be accepted (no hard suitcases or attaches). Weight allowance includes camera equipment, body cream, snacks, water, trekking wares, walking sticks and hand luggage.
The advance payment or any partial payment for a reservation on a safari package constitutes consent to all provisions of the applicable agreement. Such agreement cannot be changed or amended except in writing signed by our providers.
You acknowledge that you have fully read, understood and accept the above booking conditions on behalf of all Travelers accompanying you on this trip. Note: any Traveler who signs this service contract on behalf of any other Traveler participating in the same trip warrants to Chacha Tours Africa that he or she has full authority to do so on behalf of that Traveler.
